Here are brief descriptions of coverages that are offered by the Pool. These descriptions are intended for informational purposes only and will in no way replace the terms, conditions, exclusions or limits as contained in actual member coverage documents or policies.
Workers’ Compensation Coverage:
Colorado law requires that all employees and Board Members be covered by Workers’ Compensation coverage. It is generally defined as a schedule of benefits payable to an employee for injury, disability, dismemberment, or death as a result of occupational hazard. The payments are a liability of the employer/district. To waive Workers’ Compensation requirements for Board members, a formal Resolution must be passed by the Board evidencing same. The Pool offers a very competitive Workers’ Compensation coverage.
General Liability Coverage:
A form of insurance designed to protect the district and its Board from a wide variety of liability exposures. These exposures could include liability arising out of accidents resulting from the premises or the operations of a district, and some types of contractual liability.
Employment Practices Liability:
This coverage is designed to protect the District or its Board for claims brought by employees (current, future and/or past) for damages arising from negligent employment practices such as wrongful termination or hiring, harassment, sexual harassment, and/or whistleblower allegations. This is covered within the Pool’s public entity liability coverage form.
Public Officials Liability:
This coverage is also included within the Pool’s form. It protects the District for claims or suits alleging the wrongful acts and/or errors and omissions of the district’s Board, employees and/or volunteers. This coverage is normally excluded in a General Liability policy, and often must be purchased separately. This is covered within the Pool’s public entity liability coverage form.
Employee Benefit Administration Liability:
Covers administrative errors and omissions such as neglecting to add someone to the district’s health insurance plan, providing individual instead of family coverage, etc. This is covered within the Pool’s public entity liability coverage form.
Auto Liability:
Liability arising from the use, maintenance and/or operation of district owned vehicles. District must schedule vehicles for coverage.
Auto Physical Damage:
Physical loss or damage to a district vehicle resulting from collision, or other covered perils. Options are available for either actual cash value or replacement cost valuation. District must schedule vehicles for this coverage.
Non-owned Auto Liability:
Liability of the District arising from the use of autos that are not owned and/or leased by the district. This frequently occurs when an employee or Board member uses his or her own vehicle in the business activities of the district. This coverage would be excess to any other more specific liability insurance on the vehicle.
Excess Liability:
The Pool offers up to $5,000,000 in additional liability limits per occurrence excess of the Pool’s underlying liability coverages.
Property Coverage:
The Pool will cover the district for “All Risks” of accidental loss or damage (per coverage terms, exclusions and conditions) to physical property of the district. The district must have an insurable interest in the property (i.e. suffer a financial loss in the event it is lost or damaged) and it must be identified as a subject of coverage on the district’s property coverage.
